These Terms and Conditions ("Terms") govern your use of housing services provided by Teraheim ("Company," "we," "us," or "our") and your access to our website. By booking a property, signing a rental agreement, or using our services, you ("Client," "you," or "Tenant") agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree with any part of these Terms, you should not use our services.

1. Definitions

  • "Services" refers to corporate housing rental services, property management, and related support provided by Teraheim.
  • "Property" means the residential unit (flat, residence, or villa) rented under agreement with Teraheim.
  • "Rental Agreement" refers to the legally binding contract between the Client and Teraheim specifying rental terms, duration, and obligations.
  • "Tenant" or "Client" refers to the individual or corporate entity renting the Property.
  • "Website" refers to terahet.life and all associated pages and services.

2. Service Description and Availability

Teraheim provides furnished corporate housing rental services in Malaysia. Our services include:

  • Property matching and booking assistance
  • Fully furnished accommodations with utilities and internet
  • Local support coordination during your stay
  • Property maintenance and repair services

Service availability: Properties are subject to availability and may vary based on location and rental period. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice, though we will make reasonable efforts to inform active clients of significant changes.

Property descriptions, photos, and amenity information on our website are provided for general reference. While we strive for accuracy, actual properties may differ slightly from representations. We recommend viewing properties before finalizing agreements when possible.

3. Eligibility and Registration

To use our services, you must:

  • Be at least 18 years of age
  • Have legal capacity to enter into binding contracts under Malaysian law
  • Provide accurate and complete information during registration and booking
  • Maintain the confidentiality of your account credentials (if applicable)

Corporate clients booking on behalf of employees must have proper authorization to do so. You are responsible for ensuring all information provided is accurate and up to date.

4. Rental Terms and Payment

Rental Agreements

All property rentals are governed by a written Rental Agreement that specifies the rental period, monthly rate, included services, and tenant obligations. The Rental Agreement takes precedence over these general Terms in case of conflict.

Pricing and Fees

Monthly rental rates are quoted in Malaysian Ringgit (RM) and include:

  • Use of the furnished property and all included amenities
  • Utilities (electricity, water, gas)
  • High-speed internet service
  • Building maintenance fees (where applicable)
  • Access to local support coordinator

Rates are subject to change for future bookings but will not be modified during an active rental period unless both parties agree in writing.

Payment Terms

Payment obligations include:

  • Security Deposit: Typically equal to one month's rent, due before move-in. Refundable upon satisfactory property inspection at lease end.
  • First Month's Rent: Due before occupancy begins
  • Subsequent Payments: Due on the first day of each rental month

Late payments may incur a fee of 5% of the monthly rent per week delayed. Consistent late payment may result in lease termination.

Refund Policy

Security deposits are refundable within 14 days of lease termination, minus any deductions for property damage or outstanding bills. Prepaid rent is not refundable except in cases where we cannot fulfill the rental agreement due to property unavailability.

5. Tenant Responsibilities

As a tenant, you agree to:

  • Use the Property solely for residential purposes and not for commercial activities
  • Maintain the Property in good condition and report damage promptly
  • Comply with building rules, regulations, and community guidelines
  • Not sublet or allow unauthorized persons to occupy the Property
  • Respect neighbors and avoid disturbances, excessive noise, or disruptive behavior
  • Allow access for maintenance and inspections with reasonable notice
  • Return the Property in the same condition as received, accounting for normal wear and tear
  • Promptly notify us of any maintenance issues or safety concerns

Failure to comply with these responsibilities may result in charges for repairs, cleaning, or other remediation, which will be deducted from your security deposit or billed separately.

6. Company Responsibilities

Teraheim commits to:

  • Provide properties that meet described standards and are safe for occupancy
  • Ensure properties are clean and in working order at move-in
  • Respond to maintenance requests within 24-48 hours during business days
  • Maintain utilities and internet service throughout the rental period
  • Provide local support coordination as outlined in the Rental Agreement

We will make reasonable efforts to resolve issues promptly. However, we are not liable for delays caused by circumstances beyond our control, such as utility company failures, natural disasters, or third-party service provider issues.

7. Termination and Cancellation

Early Termination by Tenant

Tenants wishing to terminate the lease early must provide written notice at least 30 days in advance. Early termination may result in forfeiture of the security deposit unless mutually agreed otherwise in writing.

Termination by Company

We reserve the right to terminate the Rental Agreement immediately if:

  • Rent payments are more than 14 days overdue
  • The Property is used for illegal activities
  • There is significant damage to the Property beyond normal wear and tear
  • The tenant violates building rules or causes repeated disturbances
  • Unauthorized persons occupy the Property

Force Majeure

Either party may terminate without penalty if the Property becomes uninhabitable due to events beyond our control (natural disasters, government actions, etc.). In such cases, we will refund any prepaid rent on a prorated basis.

8. Limitation of Liability

To the maximum extent permitted by Malaysian law:

  • Teraheim is not liable for personal injury, property loss, or theft that occurs in or around the Property unless caused by our gross negligence
  • We are not responsible for interruptions to utilities or internet service caused by third-party providers
  • Our total liability for any claim related to these Terms will not exceed the total rent paid for the affected rental period
  • We are not liable for indirect, consequential, or punitive damages

Tenants are encouraged to obtain renter's insurance to cover personal belongings and liability.

9. Intellectual Property

All content on our website, including text, images, logos, and design elements, is owned by Teraheim or our licensors and is protected by Malaysian and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission. Limited use for personal reference in connection with our services is permitted.

10. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with Malaysian data protection regulations.

11. Dispute Resolution

Governing Law

These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

Informal Resolution

Before initiating formal legal proceedings, parties agree to attempt to resolve disputes through good-faith negotiation. Either party may request a meeting to discuss the issue within 14 days of a written complaint.

Mediation

If informal resolution fails, parties may agree to submit the dispute to mediation before proceeding to litigation.

12. General Provisions

Entire Agreement

These Terms, together with your Rental Agreement and our Privacy Policy, constitute the entire agreement between you and Teraheim regarding use of our services.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Notices

All notices under these Terms must be in writing and delivered by email or postal mail to the addresses provided in Section 13.

14. Changes to Terms

We may update these Terms periodically to reflect changes in our services or legal requirements. When we make significant changes, we will:

  • Notify active clients via email
  • Provide notice through our website

Changes become effective upon posting unless otherwise stated. Continued use of our services after changes are posted constitutes acceptance of the revised Terms. Active rental agreements will continue under the terms in effect when the agreement was signed unless both parties agree to modifications in writing.
